No Purchase, Loan or Loan Application Necessary To Enter or Win. A purchase, loan or loan application will not increase your chances of winning.
1. ELIGIBILITY: This sweepstakes is available only in the United States and is open only to legal residents of the 50 United States, including the District of Columbia, 13 years of age or older who are themselves or who is a parent or legal guardian of a full-time high school senior or college student (attending a high school or accredited college or university within the U.S.) any time between 9/7/07 and 6/30/08 (defined below). Employees, officers, directors, agents and representatives of Bank of America (hereafter, “Sponsor”), its parent, affiliates, subsidiaries, branches and advertising and promotion agencies including Project Support Team, Inc. (collectively, the “Released Parties”), and all of their immediate family members (spouses, parents, children, siblings and their respective spouses, regardless of where they reside) and all others with whom they are domiciled, whether or not related, are not eligible to enter or win. Subject to all applicable federal, state and local laws. Void in Puerto Rico and all other US Territories and Possessions and where prohibited by law. Eligible minors must have their parent’s or legal guardian’s permission to enter. You need not be a customer of Bank of America to enter, and you are not required to submit to a sales presentation.
2. ENTRY: Entrants can (1) Visit www.elearning.makingitcount.com any time from 12:00 PM (noon) Eastern Time (“ET”) on 9/7/07 through 5:00 PM ET on 6/30/08 (the “Promotion Period”), complete the registration form and submit as instructed; or (2) attend a Monster, Inc. Making College Financial Planning Count seminar (for a list of seminar locations visit www.makingitcount.com/seminar). Seminar will last approximately 1 hour between 9/7/07 and 6/30/08, complete the feedback form handed out at the beginning of the seminar (while supplies last) and return to a seminar representative to receive 1 entry into the sweepstakes. Limit one (1) entry per person per e-mail address per day, regardless of method of entry. In case of multiple online entries on any day from any one person/e-mail address, only the first online entry on such day will be accepted and all subsequent online entries received that day from that person/e-mail address will be void. No reproductions, facsimiles or photocopied entries will be accepted. The use of automated entry devices of any kind or the use of scripts, macros or other mechanical or automated means is prohibited and any such entries are void. Released Parties are not responsible for lost, late, incomplete, damaged, mutilated, inaccurate, stolen, misdirected, illegible entries or feedback forms and all such entries and feedback forms shall be ineligible. Released Parties are also not responsible for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems, telephone lines or other telephone problems, technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware), the cancellation or postponement of any seminar, or other errors or malfunctions of any kind whether human, mechanical, electronic, printing, typographical or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or problems relating to or in connection with the administration of the sweepstakes, the processing of entries or feedback forms, the announcement of the prize or appearing on the feedback form, registration form or in any other sweepstakes related materials. Other than as specifically permitted in these rules, downloaded, mechanically or otherwise reproduced entries will not be accepted and all such entries will be void. All entries and feedback forms will become the property of Sponsor.
3. WINNER SELECTION: Potential winners will be selected in a random drawing conducted by Project Support Team, Inc., an independent judging organization, on or about 7/25/08 from among all eligible entries received. By participating, entrants (or, if eligible minors, their parents or legal guardians) agree to be bound by these Official Rules and to the decisions of the Sponsor and judges, which will be final and binding in all respects. Potential winners, or a parent or legal guardian of winner who is an eligible minor, will be notified by overnight mail, regular mail and/or telephone on or about 7/28/08. If potential winner, or a parent or legal guardian of a winner who is an eligible minor, cannot be reached within five (5) business days of date of the first attempted notification, then the prize will be forfeited in its entirety and, at Sponsor’s discretion, awarded to an alternate winner. Potential winners, or a parent or legal guardian of winner who is an eligible minor, will be required to complete, sign, and return an Affidavit of Eligibility, Liability Release, IRS Form 1099, and, where lawful, Publicity Release, all of which must be received by Sponsor or its designated agent within 14 days of date of issuance of notification. If all required documentation is not returned within the stated time, or is undeliverable, or if a potential winner is otherwise not in compliance with these Official Rules, prize will be forfeited in its entirety and, at Sponsor’s discretion, awarded to an alternate winner.
4. Prizes: Ten (10) Grand Prize winners will receive: $1,000 awarded in a lump sum check which may be used toward college tuition. Total Approximate Retail Value of all prizes = $10,000. Odds of winning will depend on the total number of eligible entries received. No transfer, assignment or substitution of prize except by Sponsor who reserves the right to substitute prize of comparable or greater value as determined by Sponsor. All federal, state and local taxes on prize, if any, and any costs and expenses associated with prize acceptance and use not specifically included in the prize description herein, are the responsibility of the individual winners. Prize won by an eligible minor will be awarded in the name of the minor’s parent or legal guardian who must comply with all requirements imposed on winners set forth herein.
5. MISCELLANEOUS: All online entries must include a valid e-mail address. In the event of a dispute as to the identity of an entrant, entry will be awarded to the person named on the applicable online entry form (regardless of whether that is the name of the authorized account holder of the email address from which said online entry form was submitted). Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of this sweepstakes is a violation of criminal and/or civil laws and should such an attempt be made, Sponsor reserves the right to disqualify entrant (and void all associated entries) and seek damages and other remedies to the fullest extent permitted by law. Sponsor reserves the right, in its sole discretion, to void suspect entries or to modify, cancel or suspend the online portion of this sweepstakes should virus, bugs, non-authorized human intervention or any other causes corrupt or impair the administration, security, fairness or proper play of the sweepstakes. In any such event, Sponsor will select winners from among all eligible non-suspect online entries received up to the date of cancellation of the sweepstakes and all other eligible entries received for the entire sweepstakes. Sponsor reserves the right to invalidate any and all entries of an entrant which Sponsor, in its sole discretion, determines to be in violation of these Official Rules or any and all entries of an entrant who Sponsor determines has engaged in any act or activity which corrupts or impairs the administration, security, fairness or proper play of this sweepstakes or who is otherwise in violation of these Official Rules. Entrants (and parents/legal guardians of minor entrants) agree: 1) to Sponsor’s use of entrants’ name, voice, biography, likeness and other indicia by Sponsor and its designees in any medium now or hereafter known worldwide in perpetuity without further notice, consideration or compensation for marketing, promotion, advertising, filing and dissemination purposes, except where prohibited by law; and 2) to indemnify, defend and hold harmless Released Parties from any and all liability, claims, law suits, costs, expenses, fees, losses, injuries or damages to entrants or any other person or entity, including personal injury, death or damage to personal or real property, arising directly or indirectly from the acceptance, possession, use or misuse of the prize, participation in this sweepstakes and/or from entrant’s fraudulent or wrongful acts or omissions and 3) not to sue Released Parties for any damages arising from winner’s acceptance of or use of the Prize. Sponsor shall have the sole right to disqualify any entrants for violation of these rules or any applicable laws relating to the sweepstakes, and to resolve all disputes in its sole discretion. For student athletes enrolled or enrolling in NCAA member institution, NCAA Bylaws governing financial aid from outside sources and other NCAA rules apply.
